1. Acceptance of Terms
By accessing or using FrenzyCall ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. FrenzyCall is operated by FrenzyCall Technologies ("we", "us", "our").
2. Description of Service
FrenzyCall provides AI-powered voice receptionist services for businesses. Our platform enables businesses to automate phone call handling, appointment booking, and customer inquiry responses using artificial intelligence.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use the Service.
4. Subscription and Billing
Paid plans are billed monthly via Lemon Squeezy. Your subscription will automatically renew at the end of each billing period unless cancelled. You may cancel at any time through the billing portal. Refunds are handled on a case-by-case basis.
Usage limits (call minutes per month) vary by plan. If you exceed your plan's limit, your AI agent will be paused until the next billing cycle or until you upgrade your plan.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Use the Service to make unsolicited or automated outbound calls (spam/robocalling)
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to collect sensitive personal data (health records, financial data) without proper authorization
- Resell or redistribute the Service without a Business plan with white-label enabled
6. Call Recording and Data
Calls handled by your AI agent may be recorded, transcribed, and summarized for quality and service purposes. It is your responsibility to comply with local call recording laws, including obtaining consent from callers where required. FrenzyCall is not responsible for your compliance with local telecommunications regulations.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by FrenzyCall and is protected by intellectual property laws. Your business data and content remain yours. We do not claim ownership of your data.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party providers (Vapi.ai, Twilio, Lemon Squeezy) and may be affected by their availability. We are not liable for downtime caused by third-party services.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRENZYCALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Termination
We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time from the Settings page. Upon deletion, your data will be permanently removed, including call recordings, agent configurations, and business information.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance.
